Beginning January 1, 2025, Illinois employers with 15 or more employees will be required to comply with new pay transparency requirements under an amendment to the Illinois Equal Pay Act. We will be exploring the requirements of the new law in a series of posts, starting with a basic overview.
The law includes the following basic requirements:
- Covered employers who post for a specific position must include pay scale and benefits information in the posting.
- Employers who use a third party for job postings must provide pay and benefits information to the third party, and third party must include that information in any posting.
- Within 14 days of posting a position externally, the employer must notify internal employees of the opening.
- If there is no public or internal posting for a position, an employer must disclose the pay scale and benefits to be offered for a position before making an offer or discussing compensation and at the applicant’s request.
- Employers must maintain records of all job postings including pay scale and benefits information for at least 5 years.
